The Case
Vs.
Shelby Withers
On January 21, 2000, Shelby Withers, a special needs student, attacked Tristran Manchanda at Clearwater High School with a nail clipper file. The School District of Clearwater wants to remove Shelby from Clearwater High School. The District contends that the incident was not a manifestation of Shelby's disabilities and further contends that school administrators have done everything reasonable to accomodate shelby's needs. Removing Shelby from school will protect him and other students from future physicial conflicts.
Lynn Withers, Shelby's mother, contests the charges made by the School District of Clearwater. She feels the incident in question was a manifestation of Shelby's disabilities and further more, she feels that the School District has not done everything reasonable to accommodate her son.

Clearwater Sheep and Cattle Company
The Clearwater Sheep and Cattle Company owns 1500 acres of land adjacent to J.N. Schweitzer County Park in Clearwater County, Wisconsin, which it uses to run cattle and some sheep. The 1500 acres of meadow and grasslands run along the east branch of Brandeis Creek. The Company Uses the land from May to October and has for many years.
On August 1st, 2000 a group of Clearwater High School students went to Schweitzer Park and hiked to a spot on Brandeis Creek about a mile north of Holms Lake. On entering the trail, there is a sign put up by the county that reads, "Swim At Your Own Risk." After some of the students drank some beer and some apple cider, they went tubing in a pond created by an active beaver dam. A few days later three of the students became ill from what health officials determined was Cryptosporidiosis. Will Mable, one of the students, died.
His parents are now suing the Clearwater Sheep and Cattle Company for Wrongful Death claiming that the company knew or should have known that the creek had become polluted by runoff from animal waste and did not take reasonable steps to address this issue.

Lawton
On April 28th, 2001 Sean Lawton, Lee Smid, and Riff Randall were hanging out in the basement of Sean's house instead of attending the Clearwater High School Senior Prom. Sean's parent was not home and the young people were listening to CDs, drinking some Mitch's "Big Cow" malt liquor, watching movies, and goofing around.
At some point in the evening, Sean went upstairs and returned with his/her parent's .357 Magnum to show his/her friends. The three friends decided to play Russian Roulette. There are conflicting stories as to exactly what happened, however one fact is clear - one young man, Lee Smid, ended up dead with a gunshot wound to the head.

Carson White
On December 13th, 2002, Pat Walters was in the hall of Clearwater High School near classroom 107 when s/he was involved in a fight with Carson White. After an investigation, the Clearwater County D.A. charged Carson with battery and disorderly conduct and informed the court of her intent to also use the hate crime statute.
